Roderick Easterling AssocRICS (membership number 1222706) Standard Terms of Engagement:

  • My Client will be the person, persons or company delivering formal instructions via the ‘Instruct a Survey’ link to roderickeasterling.co.uk
  • The subject property will be the property described by my Client and detailed within instructions formally delivered to me.
  • The nature and type of service required is that selected by my Client and detailed within formal instructions delivered to me. The scope of each service has clearly been outlined at roderickeasterling.co.uk and can be found under the link headed ‘Buying a Property’.
  • Unless in writing otherwise advised by my Client, all survey inspections and reports are intended for owner occupied residential dwellings.
  • Any special instructions and/or additional services must be agreed in writing and prior to my inspection of the subject property being carried out.
  • Having received formal instructions via roderickeasterling.co.uk I will arrange for my inspection of the subject property and as soon as reasonably possible thereafter, will email my Client outlining the intended/agreed inspection date and timescale for the reports’ publication/delivery.
  • Any reports will be delivered as a PDF email attachment.
  • All fees will be agreed with my Client prior to any inspection being undertaken. Having arranged for my inspection of the subject property, when emailing my Client to outline the intended/agreed inspection date and timescale for the reports’ publication/delivery, an invoice will be attached. By means of bank transfer or bankers cheque, this invoice must be settled at any time before the date of inspection. Where settlement is to be made by means of a cheque, this must be received no less than five days prior to the date of inspection.
  • Where by means of a third party my Client has been referred to me, Roderick Easterling AssocRICS might financially compensate the referring party.
  • Where formal instructions have been delivered I will arrange for my inspection of the subject property and will also undertake pre-inspection investigations. In undertaking these works and in advance of my inspection of the subject property being undertaken, I will have commenced the written report to be published/delivered. In compensation for works already undertaken, any cancellation made more than two working days post formal instructions being delivered will incur a cancellation fee. This will be equivalent to one quarter of my fees for the service previously commissioned.
  • Where I am concerned over any possible restrictions due to heath and safety implications that may arise on the day of inspection, as soon as reasonably possible I will make my Client aware.
  • When delivering formal instructions via the ‘Instruct a Survey’ link at roderickeasterling, my Client must formally agree all ‘Terms of Engagement’. This is done by means of ticking a box found within the ‘Instruct a Survey’ link/form. Without ticking the box, formal instructions will not be delivered to me.
  • As an RICS regulated firm, files kept by me may be subject to monitoring and will need to be provided to the Royal Institution of Chartered Surveyors.
  • Any fees taken in advance are not Client money and are therefore not subject to the RICS ‘Client Money Protection Scheme’
  • Clients should be aware that I operate a ‘Complaints Handling Procedure’. Upon request, details of this procedure are available.
  • The completed, published and delivered report is for my Clients’ and their Legal Advisers information only. I do not accept responsibility if it is used or relied upon by anyone else.
  • Whatever level of service commissioned, none include an asbestos inspection and all fall outside ‘The Control of Asbestos Regulations 2012’. However, all reports will emphasise materials incorporated to the subject property that may incorporate asbestos fibres into their fabric.
  • Leasehold residential properties often require that additional matters must be considered, these to include shared responsibilities and repairing covenants. Where the leasehold property is a flat or maisonette my inspection will usually be limited to the subject property and accessible common parts/grounds. Onerous repairing liabilities may exist independently from the property, these which could include a lease imposing liability to pay a proportion of the total estate repair costs. As my Client, you are advised that no due diligence has taken place in relation to the true legal effects of a lease, this the exclusive responsibility of your Legal Advisers.
